Collaborative Family Law
Collaborative Family Law is a specialised form of negotiation which may be used to resolve family law disputes, whether these be with regard to children, financial matters such as the sharing of property, or any other family law related matter. Collaborative law allows couples to reach agreements and solutions by meeting each other directly in the company of their solicitors in four-way meetings. Agreements are normally reached after a series of meetings.
The procedure is based upon transparency, and full disclosure of all matters between the parties. The meetings are conducted in an environment of courtesy and respect. A common commitment to seeking a solution which will best suit children, and the parties, is fundamental.
The outcome of a successful collaboration is the preparation of a separation agreement
An unusual feature of the procedure is that if the collaborative procedure is embarked upon, but fails and litigation ensues, then the solicitors first instructed to carry out the collaborative procedure require to withdraw, for litigation to be conducted by others.
Only solicitors who have undergone specialised training, and are qualified in Collaborative Law, can conduct this procedure. All of the solicitors in our team are trained in Collaborative Law.
