Divorce and the finances
When you separate all assets require to be valued as at the date of separation. Once valued, the net matrimonial/civil partnership property is to be divided “fairly” between the parties. A “fair” division usually means a 50/50 split unless certain special circumstances apply. The financial matters relative to your separation must be resolved before you can get divorced.
We always do our best to resolve the financial matters relative to your separation by negotiating matters and avoiding litigation if we can. However, where it is not possible to resolve matters by traditional solicitor negotiation, mediation or collaboration, our team has extensive experience of dealing with financial provision on divorce cases in the Sheriff Court and Court of Session.
Financial provision on divorce or dissolution of a civil partnership can be very complex and it is essential that you seek legal advice. Please contact a member of our expert team on 0131 226 6541 or 0141 332 5666 for advice on financial provision on divorce or dissolution of a civil partnership.
